AZ ROC: Mesa-Based Company’s
License Summarily Suspended

PHOENIX, Ariz., (Oct. 29, 2020)- On Mon Oct. 26, 2020, the Arizona Registrar of Contractors (AZ ROC) summarily suspended B-4 General Residential Engineering Contractor License (ROC 322639), held by Bravado Pools and Landscape LLC, a Mesa-based contracting business.

The summary suspension proceedings were initiated earlier this month after AZ ROC investigated two complaints, one for abandonment of a landscaping project and one for non-payment to another licensed contractor who was hired to plaster a pool. Two other complaints filed in July 2020, where work started but was not completed, are also included in the summary suspension case after the company failed to comply with AZ ROC directives.

Based on the complaints received and the preliminary investigation, the Agency issued a summary suspension alleging eight charges including:

  • Abandonment of a contract or refusal to perform after submitting a bid on work without legal excuse for the abandonment or refusal.
  • Failure in any material respect to comply with this chapter; namely A.R.S. § 32-1158.
  • Failure by a licensee or agent or official of a licensee to pay monies in excess of $750 when due for materials or services rendered in connection with the licensee’s operations as a contractor unless the licensee proves that the licensee lacks the capacity to pay, and has not received sufficient monies as payment for the particular construction work project or operation for which the services or materials were rendered or purchased.
  • Three counts of violating any rule adopted by the Registrar; namely A.A.C. R4-9-108(a): A contractor shall perform work in a professional and workmanlike manner.
  • Two counts of failing to take appropriate corrective action to comply with this chapter or with rules adopted pursuant to this chapter without valid justification within a reasonable period of time after receiving a written directive from the Registrar.

As the investigation continues, the formal citation may be supplemented.

A summary suspension prohibits the licensee from being able to legally contract as of the day it is issued. In turn, it requires the Agency to provide the contractor a prompt hearing at the Office of Administrative Hearings. An expedited hearing has been requested.
