Electronic Update - Access Agreement/Terms and Conditions

Introduction
AZROC may provide Electronic Update Access to information relating to records stored by AZROC.
Electronic Signature

Electronic Update Access requires an Electronic Signature which consists of your user name and password or other security measures as required by AZROC. The Electronic Signature is considered to be obtained at the time of successful AZROC Login.

You, as a user of AZROC's Internet-enabled transaction services, are responsible for keeping your Login information secure and confidential.

Your Liability

You agree that use of this Electronic Signature as set forth above is the legal equivalent to your written signed instructions to AZROC, and that you will be bound by and liable for all use including unauthorized use by other persons without your knowledge or consent.

You are aware that AZROC is under no obligation to confirm the actual identity or authority of any user of the Electronic Signature or any component thereof.

Submission of an Online License Renewal Application is subject to verification and does not guarantee a license will be renewed. The License Renewal Application that is submitted will not be complete until all fees have been submitted. When the complete License Renewal Application, and applicable fees, has been received by the Department, the License Renewal Application will be reviewed for compliance with applicable statutes and rules.

Use of the Online License Renewal Application is voluntary and the Online License Renewal website is provided as a service and a convenience to the licensees. Every effort is made to keep the website up and running and available when a licensee needs to submit a license renewal application and pay a renewal fee. However, downtime by the website or the payment website does not constitute a legitimate reason for failing to submit a License Renewal Application by the renewal date of the license.

A licensee applying to renew a Registrar of Contractor's license shall submit an online license renewal application to the Department "on or before" the end of the renewal month of the license. "Upon receipt of the renewal application, the license status will be indicated on the ROC website as "current" until the application has been finally determined by ROC, or in the case the application is rejected or the terms of the new license limited, until the last day for seeking review of the ROC Order, or a later date fixed by order of the reviewing court." The "current" status will immediately be lifted and updated to "renewed" upon ROC'S granting of the renewal. A licensee will receive by mail "renewal license cards" indicating approval of the renewal application.

Neither the State of Arizona, nor any agency, officer, nor employee of the State of Arizona warrants the accuracy, reliability or timeliness of any information auto-populated on the "Online License Renewal" website. It is the licensee's responsibility to verify all information that the licensee submits in the Online License Renewal Application. The Agency is not liable for any losses caused by reliance on the accuracy, reliability or timeliness of the information. Any reliance on the information provided by this website is at the user's own risk.

By proceeding:

I agree to conduct a transaction with the Arizona Registrar of Contractors by electronic means,
I agree to submit a License Renewal Application by electronic means. I understand that the electronic License Renewal Application has the same legal effect and legal consequences as a signed paper document,
I agree that the statutes and rules of the State of Arizona apply to this transaction,
I agree that the deadlines and times applicable to this transaction are Mountain Standard Time,
I understand that my/my company's license will be suspended if I fail to renew by 12:00 PM MST of the licensees renewal month. I understand that if I fail to submit the License Renewal Application by the license renewal through date, my license will immediately be suspended. In that event I understand that I may still submit a Renewal application. However, my application must include a $50 dollar late fee in addition to the other expenses associated with the renewal. In the event that I fail to renew within one year of the renewal date of the license my license will expire and I understand that I will have to re-apply for a NEW ROC license.
I attest that the information and statements contained in this license renewal application are true and correct. I understand that misrepresentation is grounds for renewal license denial or subsequent suspension or revocation of the license.
Protection of Electronic Signature
You, as a user of AZROC's Internet-enabled transactions services, agree to keep the Electronic Signature and all components thereof secure and safe to prevent unauthorized use.
AZROC Not Liable
AZROC may cancel or restrict use of Electronic Update Access or Electronic Signature without notice to you, the user. AZROC has no liability for damages or harm which you may incur or experience as a result of any non-acceptance, delay or restriction in implementing instructions, or for any unavailability, malfunction, cancellation, restriction or withdrawal of Electronic Update Access or any portion of such service or any device associated with it.
AZROC Access
The AZROC information accessible through Electronic Update Access is that which has been specified in advance on AZROC's records and to which AZROC allows access.
Changes to Terms and Conditions
These Terms and Conditions may be subject to change. You agree to recheck them from time to time for any such changes.
General

The terms and conditions of other agreements relating to any other AZROC business you may have remain in force except as expressly altered by these Terms. If there is a conflict between any provision of those other agreements and these Terms, those agreements prevail.

For Electronic Access by a personal computer (PC) you, as a user of the AZROC's Internet-enabled transaction services, assume responsibility to keep any information stored in your PC, on disk, or any associated equipment secure from unauthorized access.

Use of Cookies

Cookies are text files placed on the customer's computer hard drive by the server (a type of computer). There are two kinds of cookies.

A session cookie is one that continues in operation only for the duration of the browser session - when the user shuts down the browser the cookie is released and goes away.

A persistent cookie continues in operation after the close of the individual session. Shutting down the browser will cause the cookie to be written into a special cookie file on the user's computer, so that the next time the user visits the Web site that generated the cookie, the cookie will be sent to the Web site's server again.

A cookie is a short piece of data. The cookie is not an executable program and cannot do anything to your machine. The AZROC uses a session cookie to enable electronic transactions. The cookie is used for no other purpose. You can prevent any cookies from being sent to your PC using the browser options. However, if you do so, or already have your browser set to do so, you may not be able to process transactions electronically.
