Repeat Offender Found Guilty of Contracting without a License
Phoenix, Ariz., (March 30, 2018) – Rodrigo Plascencia, age 37 of Glendale, was found Guilty of Contracting Without A License, a Class One Misdemeanor, in the Desert Ridge Justice Court on Wednesday, March 28, 2018.
The charges against Plascencia dba Dreaming by Design and Sun Valley Nursery LLC, stemmed from a 2016 Arizona Registrar of Contractors (AZ ROC) investigation against Plascencia, which found that he was paid $14,578 and performed substandard landscaping work at a Cave Creek residence.
Plascencia has a long history with the AZ ROC that includes 22 complaints going back to 2010. In 2015, Plascencia also pled guilty to Contracting Without a License following a different investigation and in total, has been issued $15,500 in Civil Citations and $500 in fines as a result of these investigations.
A majority of the prior complaints against Plascencia were advertising related, in which Plascencia illegally advertised contracting services for over $1000 and failed to include the phrase “not a licensed contractor” on advertising materials, both required by statute.
A sentencing hearing is set for 3:00 PM on May 14, 2018, at Desert Ridge Justice Court in Phoenix, where Plascencia could be sentenced to jail for up to 60 days and a fine of up to $2,500.
Plascencia has never been a licensed contractor in Arizona and the AZ ROC reminds the public to always do their due diligence before hiring a contractor; starting with ensuring the company is licensed. This is yet another reminder to property owners to always use licensed contracting professionals and to check the license by using the ROC website or giving the agency a call.
